Terms of Use

These Terms of Use govern your use of theyoungdentist.net. Please read them. By using the site you agree to them.

1. Who we are, and some definitions

The Young Dentist (“TYD”, “we”, “us”, “our”) is a dental education platform: a podcast, free video Masterclasses, a weekly newsletter, news and research content including a route for readers to submit their own research, and dentistry focused events, all published at theyoungdentist.net. Our mission is to support dental students and young dentists with open, practical content, free of charge.

The Young Dentist is operated by TYD NEXUS LTD, a company registered in England and Wales, company number 16905466. You can reach us at content@theyoungdentist.net.

In these Terms:

  • “the Site” means theyoungdentist.net, including all of its pages and features;
  • “Content” means everything made available on or through the Site, including podcast episodes and transcripts, Masterclasses and their modules, newsletter issues, news articles, research posts and submissions, event pages, and partner or sponsor listings;
  • “Masterclasses” means the long form video courses on the Site, including modules that sit behind free registration;
  • “Account” means a registered user profile on the Site;
  • “you” and “your” mean anyone who accesses or uses the Site, including Account holders.

2. Accepting these Terms

By accessing or using the Site in any way, including browsing, subscribing to the newsletter, registering for an Account, submitting research, registering interest in an event, or contacting us through a form, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

When you register for an Account you are asked to actively tick a box confirming that you accept these Terms and have read our Privacy Policy. That box is required, is never pre-ticked, and your acceptance is recorded with the date, the time, and the version of the Privacy Policy that was live at that moment.

These Terms apply alongside our Privacy Policy, which you should also read.

3. Who the Site is for

The Site is aimed at dental students, trainee dental professionals, qualified dentists and other dental professionals, and people with a genuine professional interest in dentistry. General Content such as podcast episodes, news, research posts and Masterclass trailers can be browsed by anyone.

To register for an Account, or to use any feature that requires registration, including watching a full Masterclass, you confirm that:

  • you are at least 18 years old;
  • you have the legal capacity to enter into a binding agreement; and
  • the information you give us when registering is accurate and up to date.

4. Your Account

To watch the full Masterclasses and use other Account based features you need a free Account. You give us at least your name, email address, and where you are in your career (for example student, foundation or vocational trainee, or qualified dentist).

You are responsible for:

  • keeping your sign-in details secure, whether you sign in with a password or with a one-time sign-in link emailed to you, and for keeping the email account you registered with secure;
  • everything that happens under your Account;
  • telling us promptly at content@theyoungdentist.net if you think someone else has accessed your Account; and
  • using one Account per person, and not registering under a false identity or on someone else’s behalf without their permission.

We may take reasonable steps to check the information you give us, so that our understanding of our audience stays accurate for reporting purposes. We do not verify your professional or student status against any regulator’s register, and holding an Account does not itself confirm that you hold any particular qualification.

You can close your Account at any time from your account page or by contacting us. Section 14 and our Privacy Policy explain what happens to your data when you do.

5. The newsletter and other emails

Our newsletter is free and optional. You join it only by ticking an optional box on one of our forms, which is never pre-ticked, and never as a side effect of accepting these Terms or of creating an Account. Where you subscribe through the newsletter form we send you a confirmation email first, and you are subscribed only once you click the link in it.

The newsletter is sent roughly once a week. We also send occasional announcements and reminders about new Masterclasses, events and webinars. We do not send third party advertising email and we do not email our list on behalf of a sponsor.

You can unsubscribe at any time using the unsubscribe link in the footer of any marketing email, from your account page, or by emailing us. Unsubscribing takes effect immediately and needs no explanation.

Separately from marketing, we send service emails connected to your Account and your submissions: sign-in links, password resets, confirmations, event details and replies to your own messages. These are part of providing the Site to you and are sent whether or not you subscribe to the newsletter.

How we handle your email address, and your rights over it, are set out in our Privacy Policy.

6. Acceptable use

When using the Site, you must not:

  • use the Site for any unlawful purpose, or in a way that breaches any applicable law or regulation;
  • infringe our intellectual property rights, or those of our guests, contributors, partners or any other third party;
  • upload or transmit any virus, malware or other harmful code;
  • attempt to gain unauthorised access to the Site, to another user’s Account, or to any of our systems;
  • scrape, harvest or systematically extract Content or data from the Site by automated means;
  • attempt to circumvent the registration wall or any other access control protecting the Masterclasses;
  • impersonate any person or organisation, or misrepresent your affiliation with one;
  • harass, abuse or harm another user, a podcast guest, a Masterclass presenter, a research contributor or any member of the TYD team;
  • submit anything through a form on the Site that is false, misleading, defamatory, unlawful, or that infringes someone else’s rights; or
  • use the Site to send unsolicited marketing or spam.

We may investigate and take the steps set out in section 14 if we reasonably believe you have breached this section.

7. Educational content only, not clinical advice

Content on the Site, including podcast episodes, Masterclasses, news articles, research posts and newsletter issues, is provided for general educational and informational purposes for a dental professional and dental student audience. It is not clinical, medical, legal, financial or other professional advice, and it is not a substitute for your own professional judgement, training and supervision.

In particular:

  • opinions expressed by podcast guests, Masterclass presenters, research contributors and other third parties are their own, and do not necessarily reflect our views;
  • nothing on the Site should be the sole basis for a clinical decision. Before applying anything you learn here in clinical practice, you must exercise your own professional judgement and comply with your professional, regulatory and legal obligations, including the standards set by the General Dental Council or other applicable regulator, and any guidance from your indemnity provider;
  • Content may become out of date, and we do not guarantee that it is current, complete or free of error;
  • the Site is not directed at patients seeking advice about their own treatment. If you are a patient, please speak to a registered dentist about your care rather than relying on anything published here.

8. Intellectual property, and your licence to use the Site

All Content, and the Site itself including its design, layout and underlying code, is owned by us or our licensors, for example guests, contributors and partners who supply material to us, and is protected by copyright, trade mark and other intellectual property laws. The TYD name, logo and brand assets belong to us.

Provided you comply with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and view Content for your own private, non-commercial, educational use.

Except where the Site expressly allows it, for example a resource file provided for download alongside a Masterclass module, you must not:

  • copy, reproduce, republish, download, redistribute, sell, sublicense, publicly perform or display, or otherwise exploit any Content;
  • remove or alter any copyright, trade mark or other proprietary notice;
  • use the TYD name, logo or brand assets without our prior written consent. Linking to, or sharing, a public page of the Site is fine; or
  • attempt to circumvent any technical protection applied to gated Content, including the Masterclasses.

Nothing in these Terms transfers any intellectual property rights to you.

9. Research submissions and other material you send us

If you submit a research abstract, article or other material to us, for example through the research submission page, you:

  • warrant that the submission is your own original work, or that you hold all rights and permissions needed to submit it;
  • warrant that it does not infringe any third party’s intellectual property, confidentiality or other rights, and that it is accurate, not misleading, and not defamatory or unlawful;
  • confirm that it contains no patient identifiable information unless you have the proper consent and have anonymised it in line with your professional and legal obligations;
  • grant us a worldwide, royalty free, non-exclusive, sub-licensable licence to reproduce, edit for house style, clarity, length or accuracy, publish, distribute, promote and archive your submission on the Site and through our other channels, including the newsletter and our social media accounts; and
  • accept that submitting something does not guarantee publication. Our editorial team decides whether, when and how to publish, and may decline or remove a submission at its discretion.

You keep ownership of your own work. The licence above lets us use it as described, it does not transfer ownership to us. If you want a published submission taken down, email us and we will discuss it with you. The consent to publish tickbox on the submission form is the record of your consent for that specific submission; this section is the general basis behind it.

10. Third party links, partners and sponsors

The Site links to third party sites and services, including YouTube, Spotify, Apple Podcasts, Instagram, TikTok and LinkedIn, and where relevant to event booking tools and partner or sponsor websites. These links are provided for convenience. We do not control, and are not responsible for, the content, accuracy, availability or privacy practices of any third party site, and a link does not mean we endorse it. Your use of any third party site is at your own risk and subject to that third party’s own terms and privacy policy.

Some Content is produced in partnership with, or sponsored by, a third party. Where that is the case it is clearly labelled. Our partners and sponsors are independent businesses. We are not responsible for their products, services or conduct, and appearing on our Partners page or sponsoring Content does not make anyone our agent or joint venturer.

11. Disclaimers

The Site and all Content are provided “as is” and “as available”. To the fullest extent permitted by law we exclude all warranties, express or implied, including as to accuracy, completeness, reliability, availability and fitness for a particular purpose. We do not guarantee that the Site will be uninterrupted, secure or error free, not least because parts of it depend on third party platforms, such as video delivered through YouTube, that are outside our control.

Nothing in this section limits the liability we cannot lawfully exclude, as set out in section 12.

12. Limitation of liability

Nothing in these Terms excludes or limits our liability for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation; or
  • any other liability that cannot lawfully be excluded or limited under the law of England and Wales, including where applicable under the Consumer Rights Act 2015.

Subject to that, and to the fullest extent permitted by law:

  • we exclude all liability for indirect or consequential loss, and for loss of profits, business, revenue, goodwill or anticipated savings, arising from your use of, or inability to use, the Site;
  • we are not liable for any loss or damage arising from your reliance on any Content in clinical practice or otherwise, given the educational only nature of Content described in section 7;
  • we are not liable for the acts or omissions of third parties, including guests, contributors, partners, sponsors or other users; and
  • because the Site and all Content are provided free of charge, our total liability to you arising out of or in connection with these Terms or your use of the Site is limited in aggregate to £100.

If you are using the Site wholly or mainly outside a trade, business, craft or profession, you have statutory rights as a consumer that these Terms do not affect.

13. Indemnity

You agree to indemnify us, and our officers, employees, contributors and agents, against reasonably foreseeable claims, losses, liabilities, damages, costs and expenses, including reasonable legal costs, arising from your breach of these Terms, your misuse of the Site or the Masterclasses, or any material you submit that infringes a third party’s rights or is otherwise unlawful.

14. Suspension and termination

We may suspend or terminate your Account, or your access to the Site or the Masterclasses, with or without notice, if:

  • you breach these Terms;
  • we reasonably suspect fraudulent, unlawful or abusive use of your Account;
  • we are required to by law; or
  • we decide to discontinue or materially change the Site or a particular feature.

You can close your Account at any time from your account page or by emailing content@theyoungdentist.net. When an Account is closed, by you or by us, we handle your personal data as set out in our Privacy Policy.

The parts of these Terms that by their nature are meant to continue, including intellectual property, disclaimers, limitation of liability, indemnity and governing law, still apply after your Account is closed or these Terms otherwise end.

15. Changes to these Terms

We may update these Terms from time to time, for example to reflect changes to the Site, to the law, or to how the Masterclasses or other features work. The current version is always at theyoungdentist.net/terms/, showing the date it was last updated.

Where we make a material change we will try to flag it, for example in the newsletter or with a notice on the Site. Continuing to use the Site or your Account after a change takes effect means you accept the updated Terms. If you do not agree with a change, please stop using the Site, and you may close your Account.

16. Privacy

How we collect, use and protect your personal data, including for the newsletter, Masterclass registration, research submissions, event interest and measuring how Content is used, is set out in full in our Privacy Policy. That policy forms part of, and should be read alongside, these Terms. If anything in these Terms and the Privacy Policy appears to conflict on a data handling point, the Privacy Policy takes priority.

17. Governing law and jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them, including non-contractual disputes, are governed by the law of England and Wales. The courts of England and Wales have jurisdiction over any such dispute. If you are a consumer resident in Scotland or Northern Ireland, you may also bring proceedings in the courts of the part of the UK where you live.

18. General

  • Severability. If any part of these Terms is found unlawful or unenforceable, the rest continues to apply.
  • Entire agreement. These Terms, together with our Privacy Policy, are the entire agreement between you and us about your use of the Site, and replace any earlier versions or understandings.
  • No waiver. If we do not enforce a right on one occasion, that does not mean we give it up.
  • Assignment. We may transfer our rights and obligations under these Terms, for example as part of a business reorganisation. You may not transfer yours without our written consent.
  • Third party rights. Nobody other than you and us has any right to enforce these Terms, including under the Contracts (Rights of Third Parties) Act 1999.
  • No partnership. Nothing in these Terms creates a partnership, agency, joint venture or employment relationship between you and us.
